Terms of Service

By accessing or using Curative Assist ("Service", "we", "us", or "our") at curativeassist.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and Curative Assist, LLC, a Florida limited liability company ("Company").

Curative Assist is an AI-powered title curative intelligence tool that assists title professionals with:

• Reviewing title commitments, deeds, recorded documents, surveys, and related instruments
• Identifying and prioritizing curative issues
• Drafting emails, documents, and correspondence related to title curative matters
• Searching for contact information for parties involved in curative matters
• Storing case files, notes, and contact information for professional use

IMPORTANT: Curative Assist uses artificial intelligence to assist with title curative work. By using this Service you acknowledge and agree that:

• AI-generated analysis, documents, and emails may contain errors, omissions, or inaccuracies
• All output must be reviewed and verified by a licensed title professional before taking any action
• This Service does not constitute legal advice and is not a substitute for the judgment of a licensed attorney or title professional
• Statute citations and legal authority references should be independently verified before reliance
• The Company makes no warranty that any output is complete, accurate, current, or suitable for any particular purpose
• You assume full responsibility for any action taken based on output generated by this Service

• You must be at least 18 years of age to use this Service
• This Service is intended for use by title professionals, title agents, and title companies
• Access is currently limited to approved users during the private beta period
• The Company reserves the right to approve, deny, or revoke access at its sole discretion
• You may not share your login credentials with any other person

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account
• We use Clerk for authentication. Your login credentials are managed by Clerk and subject to their security practices
• Team accounts allow multiple users within the same organization to access shared case history and files

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe upon the intellectual property rights of any third party
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any purpose other than legitimate title professional work
• Resell, sublicense, or transfer access to the Service without written permission
• Reverse engineer, decompile, or attempt to extract the underlying AI models or prompts

• Documents you upload are stored securely and used solely to generate analysis and output for your use
• Documents you upload are retained according to your chosen retention period, configurable in Account Settings. Options range from end of session to indefinite storage. Default retention is 30 days. You can change your retention period at any time in Account Settings.
• Case files, notes, contacts, and analysis results are stored according to your retention setting and deleted automatically when that period expires, unless you choose to keep data indefinitely
• We do not sell, share, or use your uploaded documents or analysis results to train AI models
• You retain all ownership rights to documents you upload and content you create
• We store data using Supabase, a SOC 2 compliant database provider

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at curativeassist.com/privacy.

• The Service, including its design, features, AI models, and underlying technology, is owned by Curative Assist, LLC and protected by applicable intellectual property laws
• You retain ownership of all documents you upload and content you create using the Service
• Output generated by the Service using your documents and inputs is owned by you
• You grant us a limited license to process your uploaded content solely for the purpose of providing the Service

• Access to the Service is subject to applicable subscription fees or per-file charges as described on our pricing page
• Fees are subject to change with 30 days notice
• All fees are non-refundable except as required by law or as expressly stated in a refund policy
• We use Stripe for payment processing. Your payment information is handled by Stripe and subject to their security practices
• We reserve the right to suspend access for non-payment

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE
• ANY OUTPUT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PURPOSES
• THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, CURATIVE ASSIST, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Errors or inaccuracies in AI-generated output
• Actions taken or not taken based on Service output
• Loss of data or documents
• Business interruption

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Curative Assist, LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party rights.

• These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles
• Any disputes arising from these Terms shall be resolved in the state or federal courts located in Florida
• You waive any objection to jurisdiction or venue in such courts

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

• We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion
• You may terminate your account at any time by contacting us at cory@defaultingtoai.com
• Upon termination, your right to use the Service ceases immediately
• We will retain your data for 30 days after termination before deletion
